Terms & Conditions for AfspraakWacht

These Terms & Conditions ("Terms") govern your use of AfspraakWacht (the "App"), operated by Yassin ("we", "us"). By downloading, installing, or using the App, you agree to these Terms. If you don't agree, please don't use the App.

1. What AfspraakWacht is — and isn't

AfspraakWacht is an independent monitoring tool that checks publicly available appointment-availability information from the Dutch Immigration and Naturalisation Service (IND) and participating Dutch municipalities (gemeenten), and notifies you when a slot matching your criteria appears to be open.

AfspraakWacht does not book, hold, reserve, or guarantee any appointment. When you receive a notification, you must go to the relevant official website yourself and complete the booking there, in competition with everyone else who sees the same opening. We have no control over, and no visibility into, whether you succeed in booking it.

AfspraakWacht is not affiliated with, endorsed by, or officially connected to the IND, any Dutch municipality, or the Dutch government in any way. Any references to the IND, gemeenten, or their names and logos in the App are used solely to identify which official service a given monitor relates to, and do not imply any partnership or endorsement.

2. No guarantee of results

We do our best to check for available appointments frequently and notify you promptly, but we cannot and do not guarantee that:

every available appointment will be detected;
a notification will reach you instantly, or at all (push notification delivery depends on Apple's infrastructure and your device settings, which are outside our control);
a slot will still be available by the time you act on a notification;
the government booking systems we read from are accurate, complete, or up to date at any given moment;
the App will be available without interruption, or that a government website's booking system won't change in a way that temporarily or permanently breaks our ability to monitor it.

You are solely responsible for your own appointment-related deadlines and legal obligations. AfspraakWacht is a convenience tool, not a substitute for checking official channels yourself or seeking appropriate legal/immigration advice for anything time-sensitive or high-stakes.

3. Eligibility

You must be capable of entering into a legally binding agreement to use AfspraakWacht. If you are using the App on behalf of someone else (for example, a family member applying for a residence permit), you confirm you're authorized to do so on their behalf.

4. Free and Pro subscriptions

AfspraakWacht offers a free tier (limited to one active monitor, checked periodically) and a Pro subscription (more monitors, faster checking, and additional notification options). Pro is offered as an auto-renewing subscription, billed monthly or yearly.

All payment, billing, renewal, and cancellation is handled entirely by Apple through the App Store — we never receive or store your payment details. To manage, cancel, or request a refund for your subscription, use your Apple ID's Subscriptions settings or contact Apple Support directly; we're not able to process cancellations or refunds on Apple's behalf. Subscription prices and any changes to them will always be shown to you by Apple before you're charged.

5. Acceptable use

You agree not to:

use the App for any unlawful purpose;
attempt to interfere with, overload, or disrupt our servers or the government systems we monitor;
attempt to reverse-engineer, circumvent, or abuse the free/Pro tier limits;
use the App to monitor on behalf of a business reselling appointment slots or access.

We may suspend or terminate access for anyone who violates these Terms.

6. Intellectual property

The AfspraakWacht app, its design, and its original content are owned by us. Government logos, trademarks, and names shown in the App belong to their respective owners (the IND and the relevant municipalities) and are used only for identification purposes, as described in Section 1.

7. Limitation of liability

To the fullest extent permitted by law, AfspraakWacht and its developer are not liable for any indirect, incidental, or consequential damages arising from your use of the App — including, without limitation, missing an appointment, a delayed or missed notification, or any consequence of a government process (immigration, municipal, or otherwise) that AfspraakWacht does not control. The App is provided "as is" and "as available," without warranties of any kind, to the maximum extent permitted by applicable law.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Dutch or EU consumer protection law.

8. Changes to the App or these Terms

We may update the App and these Terms from time to time. If we make material changes to these Terms, we'll update the "Last updated" date above. Continuing to use the App after changes take effect means you accept the updated Terms.

9. Termination

You can stop using AfspraakWacht at any time by deleting the App. We may suspend or discontinue the service, in whole or in part, at any time — for example, if a government system we depend on becomes permanently unavailable to us.

10. Governing law

These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-law principles. Any dispute will be subject to the exclusive jurisdiction of the competent courts in the Netherlands, except where mandatory consumer protection law gives you the right to bring a claim in your own country of residence.

11. Privacy

Our handling of your data is described in our Privacy Policy, which forms part of these Terms.
